Kirn Terms of Service

1 Acceptance of Terms

By accessing any Kirn product, registering a Kirn Workspace account, or accessing our web dashboards, you agree to be bound by these Terms of Service and our Privacy Policy.

If you are entering into this agreement on behalf of a company or legal entity, you represent that you possess the authority to bind such entity to these conditions.

2 License Grant & Software Use

Subject to compliance with these terms, Kirn grants you a limited, revocable, non-exclusive, non-transferable license to access and run the official Kirn software products (including ClientSift, Client Connect, Design Layer, and Workspace Hub) solely for your internal personal or business operations.

You may not reverse-engineer, decompile, resell, or distribute modified packages of the software without prior written permission from Kirn.

3 Account Responsibilities & Fair Use

You are responsible for maintaining the confidentiality of your workspace login tokens and all activities conducted through your account.

• Outreach & Communication Compliance: When utilizing Kirn Client Connect or related communication workflows, you agree to abide by all relevant anti-spam laws (including CAN-SPAM, CASL, and GDPR) and honor all recipient opt-out requests immediately.
• No Abuse of Third-Party Platforms: You agree not to use Kirn tools in any manner that violates the terms of service of third-party platforms you interact with.
• Rate Limits: Excessive automated queries that disrupt relay servers or degrade network performance may result in temporary account throttling.

4 Subscriptions, Payments & Cancellations

Kirn provides both free exploration tiers and premium paid subscriptions. Paid features are billed in advance on a monthly or annual cycle.

You may cancel your subscription at any time via your workspace billing dashboard. Upon cancellation, you will retain access to paid features until the end of your current prepaid billing period.

We offer a no questions asked 14 day refund window for initial paid subscriptions upon written request to kiran@kirnsoftware.com.

5 Intellectual Property & Customer Data

Your Data: You retain complete and exclusive ownership of all lead files, message drafts, design palettes, and workspace content created or imported by you.

Kirn IP: The Kirn brand, official logo insignia, website designs, source code, neural algorithms, and documentation remain the exclusive intellectual property of Kirn and its licensors.

6 Disclaimers & Limitation of Liability

Kirn services and software products are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied.

To the maximum extent permitted by applicable law, in no event shall Kirn be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or data arising out of or related to your use of our software.

7 Governing Law & Contact

These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
